HOUSE RESOLUTION

 

 

requesting the city and county of honolulu, county of maui, and county of kauai pass ordinances similar to the county of hawaii's bill 82 (2023-2024) relating to improving private roads.

 

 

 

     WHEREAS, there are many private, nondedicated and non-surrendered roads throughout the State of Hawaii that are open to and utilized by the general public; and

 

     WHEREAS, section 265A-1, Hawaii Revised Statutes, grants the several counties the power, by ordinance, to improve, grade, repair, or do any construction upon private streets; and

 

     WHEREAS, the owners of private roads often do not have the resources to improve or correct deficiencies on these roads; and

 

     WHEREAS, while the counties have different policies relating to private roads, generally they will not unilaterally repair or upkeep private roads to county standards; and

 

     WHEREAS, the public interest is served by the counties performing improvements to private roads that are used by the public; and

 

     WHEREAS, the County of Hawaii has passed into law Bill 82 (2023-2024) authorizing the county to improve, grade, repair or do construction work upon private, nondedicated, and non-surrendered roads; now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Thirty-second Legislature of the State of Hawaii, Regular Session of 2024, that the county councils of Honolulu, Maui, and Kauai consider passing an ordinance similar to the County of Hawaii's Bill 82 (2023-2024) relating to improving private roads; and

 

     BE IT FURTHER RESOLVED that certified copies of this Resolution be transmitted to all members of the Honolulu City Council, Maui County Council, and Kauai County Council.
