A BILL FOR AN ACT

 

 

RELATING TO ROAD IMPROVEMENTS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that Hana highway serves as the primary route for the residents of east Maui to reach services, employment, college, healthcare, and businesses in central Maui.  Additionally, the road to Hana experience is a highly popular tourist activity, with an estimated average of one thousand nine hundred daily trips on Hana highway occurring in 2019.

     The legislature additionally finds that the road to Hana is 64.4 miles long, contains fifty-nine bridges, has multiple culverts, has six hundred twenty curves and blind turns, and includes some areas allowing only one-way traffic.  The natural terrain of the area also includes densely forested mountains, waterfalls, streams, and cliffs.

     The legislature finds that the condition of Hana highway is in severe need of repair and maintenance and the highway has become unsafe in several locations.  These conditions can cause delays in the delivery of life saving services, create extended commutes for residents, and cause accidents.

     Accordingly, the purpose of this Act is to appropriate funds for the equipment and personnel necessary to address needed improvements to Hana highway.

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2024-2025 for equipment and      full-time equivalent (     FTE) position to conduct and administer the following improvements on Hana highway:

     (1)  Road repairs;

     (2)  Brush clearing and vegetation maintenance;

     (3)  Additional and replacement signage;

     (4)  Repairs to emergency call boxes; and

     (5)  Other activities as necessary.

     The sum appropriated shall be expended by the department of transportation for the purposes of this Act.

     SECTION 3.  In accordance with section 9 of article VII of the Hawaii State Constitution and sections 37‑91 and 37‑93, Hawaii Revised Statutes, the legislature has determined that the appropriations contained in H.B. No.     , will cause the state general fund expenditure ceiling for fiscal year 2024‑2025 to be exceeded by $           or      per cent.  In addition, the appropriation contained in this Act will cause the general fund expenditure ceiling for fiscal year 2024‑2025 to be further exceeded by $           or      per cent.  The combined total amount of general fund appropriations contained in only these two Acts will cause the state general fund expenditure ceiling for fiscal year 2024‑2025 to be exceeded by $           or      per cent.  The reasons for exceeding the general fund expenditure ceiling are that:

     (1)  The appropriation made in this Act is necessary to serve the public interest; and

     (2)  The appropriation made in this Act meets the needs addressed by this Act.

     SECTION 4.  This Act shall take effect on July 1, 3000.
