A BILL FOR AN ACT
RELATING TO AIRPORT VISITORS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that many individuals without airline boarding passes wish to accompany traveling friends and family members to airline gates, which are beyond airports' security checkpoints. The legislature recognizes that federal law grants states flexibility in establishing programs to authorize these visits.
The purpose of this Act is to require the department of transportation to establish and implement at Daniel K. Inouye International Airport a non-traveler visitor pass program.
SECTION 2. Chapter 261, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§261-
Non-traveler
visitor pass program. (a)
The department shall establish and implement at Daniel K. Inouye
International Airport a non-traveler visitor pass program for individuals
without airline boarding passes. Each
passholder may visit the airport beyond the federal Transportation Security
Administration checkpoints for the purpose of:
(1) Accompanying another person who has an airline boarding pass to or from an airline gate, or from an airline gate to the baggage claim area or ground transportation facilities; or
(2) Engaging in any other lawful activity authorized by the department.
(b)
The department shall coordinate with the federal Transportation Security
Administration and other appropriate governmental agencies in creating and
managing the program.
(c) The department may impose:
(1) Limitations on the number of non-traveler visitor passes that may be issued on any day;
(2) Limitations on the amount of time that a non-traveler visitor may remain beyond a federal Transportation Security Administration checkpoint; and
(3) Other limitations intended to ensure airport security.
(d) The department shall adopt rules pursuant to chapter 91 necessary for the purposes of this section."
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect on July 1, 2024.
