A BILL FOR AN ACT
RELATING TO COLLECTIVE BARGAINING.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that repricing is the reassignment of an existing class from one pay range to another without a change in duties when it has been found that the class is not in proper internal alignment with other classes in the same bargaining unit. Act 253, Session Laws of Hawaii 2000, repealed chapter 77, Hawaii Revised Statutes, regarding the state compensation law, and with it, the public employee compensation appeals board that heard and made decisions on repricing requests. In its place, the Act established the repricing processes in section 89-9, Hawaii Revised Statutes, in which the exclusive representative may negotiate the repricing of classes. If repricing is not negotiated, a five-year periodic repricing review is conducted by each jurisdiction.
The purpose of this Act is to require the department of human resources development to:
(1) Conduct a study to review the repricing processes in section 89-9, Hawaii Revised Statutes; and
(2) Submit a report to the legislature prior to the convening of the regular session of 2024.
SECTION 2. (a) The department of human resources development shall conduct a study to review the repricing processes in section 89-9, Hawaii Revised Statutes.
(b) The study shall review the various repricing mechanisms available in section 89-9, Hawaii Revised Statutes, to determine if existing repricing review processes are adequate and appropriate. In conducting the review, the department of human resources development shall consider a process that best ensures equal pay for equal work as mandated in section 76-1, Hawaii Revised Statutes, and maintains a consistent system to evaluate repricing requests so that the employer can comply with federal and state laws that prohibit discrimination in employment.
(c) The department of human resources development shall invite the following organizations to participate in the study:
(1) Representatives from each of the counties, Hawaii health systems corporation, judiciary, and department of education who are knowledgeable about classification and the repricing process;
(2) Hawaii Government Employees Association;
(3) United Public Workers, American Federation of State, County and Municipal Employees, Local 646, AFL-CIO; and
(4) Any other employer, representative, or agency deemed appropriate by the department of human resources development.
(d) The department of human resources development shall submit a report of its findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2024.
SECTION 3. This Act shall take effect on June 30, 3000.
