A BILL FOR AN ACT

 

 

RELATING TO PROFESSIONAL AND VOCATIONAL LICENSING.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1. The legislature finds that in 2012 Act 248 created HRS §436B-14.8 allowing military members to present their education, training and service completed as part of their qualification requirements for licensing within the state.  This legislation had a 2022 sunset date.

     The purpose of this bill is to reenact the statute without a sunset date.

     SECTION 2.  Chapter 436B, Hawaii Revised Statutes, is amended by reinstating a section to read as follows:

     "§436B-14.8  Licensure; acceptance of military education, training, or service.  Notwithstanding any law to the contrary, every licensing authority subject to this chapter, upon presentation of satisfactory evidence by an applicant, shall consider relevant education, training, or service completed by an individual as a member of the armed forces or reserves of the United States, the National Guard of any state, the military reserves of any state, or the navy militia of any state as part of the evaluation process toward the qualification requirements to receive the license.  Evidence presented for consideration for fulfillment or partial fulfillment of licensing requirements shall demonstrate substantial equivalency to state standards."

     SECTION 3.  The licensing administrator of the professional and vocational licensing division of the department of commerce and consumer affairs shall communicate the intent and parameters of this Act to each licensing authority and shall submit a report detailing plans for the implementation of this Act to the legislature no later than twenty days prior to the convening of the regular session of 2024.

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect on July 1, 2023.

Description:

Requires professional and vocational licensing boards to consider relevant military education, training, and service as part of the evaluation process toward the qualifications of a license.  Requires the licensing administrator of the professional and vocational licensing division of the department of commerce and consumer affairs to communicate the intent of this Act to each licensing authority and report to the legislature.
