DELAWARE STATE SENATE

145th GENERAL ASSEMBLY

SENATE BILL NO. 256

AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO RECIPROCAL PREFERENCES.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1.Amend Subchapter I, Chapter 69, Title 29, Delaware Code by adding thereto the following:

"§6909A.Reciprocal Preference.

To ensure fair and open competition for Delaware businesses engaged in contracting with other states, a reciprocal preference may be imposed against bidders from those states which apply preferences.In determining whether a bidder qualifies as a resident bidder, the definition used by the other state in applying a preference shall apply.".


SYNOPSIS

A number of states give local businesses some sort of preference when they contract for goods and services.Preferences may be "all other things being equal" it goes to the local business or some percentage by which the local business' bid may be higher than an out-of-state business's bid.This Act simply says that whatever another state does to Delaware businesses, Delaware may do to businesses from that State.
