DELAWARE STATE SENATE

145th GENERAL ASSEMBLY

SENATE BILL NO. 214

AN ACT TO AMEND TITLE 7 OF THE DELAWARE CODE RELATING TO OUTDOOR LIGHTING REGULATION.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1.Amend Section 7102A(c), Title 7, Delaware Code by deleting the word "or" appearing in subsection (5) thereof, and further by replacing the period "." at the end of subsection (6) thereof with a semicolon (;),and further by inserting the following new subsections (7) and (8) to this subsection, to read as follows:

"(7) The new or replacement outdoor lighting fixture is to be installed and operated on roadways and supporting interchanges that are classified by the Department of Transportation's Functional Classification Maps as Interstate or Other Freeway/Expressways within the urbanized boundaries and Other Principal Arterials that are designed to Interstate or freeway/expressway standards in non-urbanized areas; or

(8) As to maintenance of existing lighting systems, the change to a cutoff luminaire would require the redesign and reconstruction of the system to compensate for the different lighting characteristics of these fixtures."


SYNOPSIS

This Bill provides two exemptions from the use of cutoff luminaires on DelDOT lighting systems.The first is for lighting of interstates, expressways, freeways and interchanges where by the nature of the roadways and widths, proper illuminance is more difficult and expensive to achieve because significantly greater numbers of poles and fixtures can be required.The second is for maintenance of existing facilities, such as repairing or replacement of a fixture within a series of lights.Replacing these existing fixtures with a cutoff fixture requires a full design re-evaluation and possible reconstruction of the system (including installation of additional fixtures) in order to maintain recommended luminance, because the lighting characteristics of cut-off luminaries/fixtures is different from other devices.Passage of this Bill will result in reduction of costs associated with new design of these types of facilities where complying with the law creates the need for many additional fixtures which is both an increase in capital and operations dollars.
