SENATE BILL NO. 108

AN ACT TO AMEND TITLE 14 OF THE DELAWARE CODE RELATING TO THE SUDDEN CARDIAC ARREST PREVENTION ACT.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1.This Act shall be known and may be cited as the Sudden Cardiac Arrest Prevention Act.It may also be known as Grace Firestone's Law.

Section 2. Amend Chapter 3, Title 14, Delaware Code by making insertions as shown by underlining and deletions as shown by strikethrough as follows:

§303ASudden Cardiac Arrest Prevention

(a)Definitions.

The following words and phrases when used in this section shall have the meanings given to them in this section unless the context clearly indicates otherwise:

(1) "Interscholastic athletics" includes practices, interschool practices and scrimmages.

(2) "DIAA" means the Delaware Interscholastic Athletic Association.

(b)Educational materials.

(1) The DIAA shall develop and post on their publicly accessible Internet website guidelines and other relevant materials to inform and educate students participating in or desiring to participate in an athletic activity, parents, officials and coaches about the nature and warning signs of sudden cardiac arrest, and the risks associated with continuing to play or practice after experiencing one or more symptoms of sudden cardiac arrest, including fainting, difficulty breathing, chest pains, dizziness and abnormal racing heart rate.

(2) In developing the guidelines and materials, the DIAA may utilize existing materials developed by organizations such as Parent Heart Watch and Sudden Arrhythmia Death Syndromes.

(3) A student participating in or desiring to participate in interscholastic athletics and the student's parent or guardian shall, each school year and prior to participation by the student in interscholastic athletics, sign and return to the student's school an acknowledgment of receipt and review of an information sheet developed under this subsection of symptoms and warning signs of possible sudden cardiac arrest.

(c) Informational meeting.A school entity shall hold an informational meeting prior to the start of each athletic season for all ages of competitors regarding the symptoms and warning signs of possible sudden cardiac arrest. In addition to students, parents, coaches and other school officials, informational meetings may include physicians, pediatric cardiologists and athletic trainers.

(d)Removal from and return to play.

(1) A student who, as determined by a game official, coach from the student's team, certified athletic trainer, licensed physician or other official designated by the student's school entity, exhibits signs or symptoms of possible sudden cardiac arrest while participating in interscholastic athletics shall be removed by the coach from participation at that time, subject to paragraph (3) of this subsection.

(2) If a student is known to have exhibited signs or symptoms of possible sudden cardiac arrest at any time prior to or following interscholastic athletics, the student shall be prohibited from participating in interscholastic athletics, subject to paragraph (3) of this subsection.

(3) A student removed or prohibited from participating in interscholastic athletics under paragraph (1) or (2) of this subsection shall not return to participation until the student is evaluated and cleared for return to participation in writing by a licensed physician, advanced practice nurse or cardiologist.

(e) Training course.

(1) All coaches and officials of interscholastic athletics shall complete sudden cardiac arrest training consistent with a timetable and curriculum established by the DIAA.

(2) No coach or official shall participate in interscholastic athletics until completing the training course required under this subsection.

(f)Penalties.The DIAA shall establish the following minimum penalties for a coach found in violation of the requirements under subsection (d) of this section:

(1) For a first violation, suspension from coaching interscholastic athletics for the remainder of the season.

(2) For a second violation, suspension from coaching interscholastic athletics for the remainder of the season and for the next season.

(3) For a third violation, permanent suspension from coaching interscholastic athletics.

(g) Other youth athletic activities.The sponsors of youth athletic activities not associated with interscholastic athletics are encouraged to follow the guidance stated in this section.

Section 3.Nothing in this Act shall be construed to create, establish, expand, reduce, contract or eliminate any civil liability on the part of any school entity or school employee.

Section 4. The DIAA shall adopt rules and regulations applicable to member schools to implement the provisions of this Act which shall be effective no later than the 2014-2015 school year except that the minimum penalties mandated by this Act pursuant to §303A(f) shall not be imposed until 2 years after the Act's enactment into law.


SYNOPSIS

This Sudden Cardiac Arrest Prevention Act (also to be known as Grace Firestone's Law) provides for dissemination of educational materials about, and mandating standards for, protecting those exhibiting signs of possible sudden cardiac arrest.It also mandates sudden cardiac arrest training for coaches and officials of interscholastic athletics.
