HOUSE BILL NO. 383

AN ACT TO AMEND TITLE 24 OF THE DELAWARE CODE RELATING TO THE MEDICAL PRACTICE ACT.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1.Amend Title 24, Chapter 17 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:

§1729 Home health care orders from out-of-state physicians.

(a)Notwithstanding any other provision of this chapter or other law, a physician who is certified, licensed, or otherwise authorized to practice medicine in another state shall be exempt from the certification and registration requirements of this chapter in order to prescribe home health care services provided by a home health care agency licensed pursuant to Title 16 of the Delaware Code to a patient who resides in this State.

(b)The prescription of home health care services under this section must first be made pursuant to an in-person physical examination of the patient performed within the jurisdictional boundaries of the state in which the prescribing physician is certified, licensed or otherwise authorized to practice medicine.


SYNOPSIS

This legislation amends the Medical Practice Act to address home health care services ordered for Delaware residents by physicians from another state.This legislation allows a Delaware licensed home health agency to deliver home health care to a patient who resides in Delaware upon an order of a physician from another state who holds a license in good standing in the other state.The intent of this legislation is to permit individuals who have sought medical treatment in another state and need subsequent home health care services to obtain those services without obtaining an intermediary Delaware physician to write an order for home health care services to be rendered in Delaware.
