An Act

 

amending title 5, Arizona Revised Statutes, by adding chapter 13; relating to youth sports.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Title 5, Arizona Revised Statutes, is amended by adding chapter 13, to read:

CHAPTER 13

YOUTH SPORTS

ARTICLE 1. GENERAL PROVISIONS

START_STATUTE5-1501. Definitions

In this chapter, unless the context otherwise Requires:

1. "consumer" means any individual participating in or intending to participate IN a YOUTH sports activity and the parents or legal guardians of youth consumers. 

2. "Department" means the Department of insurance and financial institutions.

3. "Youth sports Activity" means any organized sports activity conducted by a private organization that involves the collection of fees and the organization of leagues, games, matches or other events for youth consumers.

4. "youth sports organization" means any private entity or organization that organizes youth sports activities, leagues or other events.  END_STATUTE

START_STATUTE5-1502. Enforcement; registration; civil penalties collection; grievance process

A. The department shall establish policies and procedures to implement, oversee and enforce the requirements of this chapter.

B. Civil penalties issued for violations of this chapter shall be collected and held by the department.

C. The department shall establish a grievance process that allows consumers to report noncompliance with the REQUIREMENTS of this chapter.

d. A municipality or county may not enact any ordinance or rule that SUPERSEDES this chapter.  END_STATUTE

START_STATUTE5-1503. Youth sports organization registration; event licensing requirement; fees; civil penalty

A. Any youth sports organization that organizes youth sports activities in this state shall register with the department. The registration shall be renewed every two years. 

B. All youth sports organizations shall obtain an event license issued by the department for any youth sports activity held in this state. The department may issue multi-year event licenses to a youth sports organization for a discounted fee.

C. The department may establish a REgistration fee for each youth sports organization and a license fee for each youth sports activity.

D. Any youth sports organization that fails to register with the department or to obtain a license pursuant to this section is subject to a civil penalty of $10,000 per violation. END_STATUTE

START_STATUTE5-1504. Participant registration; fees; penalties

A. A consumer participating in a youth sports activity is required to register with the youth sports organization that is organizing the youth sports activity. The youth sports organization shall issue The consumer participating in the youth sports activity a participant identification that specifies the age of the consumer.

B. The department may establish a registration fee for BOTH in-state and out-of-state consumers participating in a youth sports activity.

C. If a planned youth sports activity does not take place other than for reasons of cancellation due to weather, the youth sports organization is required to refund a minimum of eighty percent of the registration fees for the youth sports activity. END_STATUTE

START_STATUTE5-1505. Safety requirements; civil penalty; definition

A. A youth sports organization that is conducting a youth sports ACTIVITY shall have an emergency medical care technician on-site at the youth sports activity. The emergency medical care technician shall be equipped with at minimum an automated external defibrillator. 

b. The youth sports organization shall provide one emergency medical care technician for every five hundred consumers participating in a youth sports activity.

c. If a youth sports organization is conducting a youth sports activity on the property of a public school and the youth sports organization violates any of the requirements of this section, the school may not be held liable for any civil penalties that may be imposed pursuant to this section as a result of the violation.

d. A youth sports organization that does not comply with the requirements of this section is subject to a civil penalty of $5,000 per violation.

e. for the purposes of this section, "emergency medical care technician" has the same meaning prescribed in section 41-1831. END_STATUTE

START_STATUTE5-1506. Coaching; background checks

a. A youth sports organization that is conducting a youth sports activity shall perform a background check, including a fingerprint check, on all coaches participating in the youth sports activity. 

b. The department may revoke the license and registration of any youth sports organization that fails to PERFORM a background check as REQUIRED by this section. END_STATUTE

Sec. 2. Short title

This act may be cited as the "Youth Sports, Safety, Integrity and Consumer Protections act".
