AN ACT

 

Amending title 41, chapter 7, article 12, Arizona Revised Statutes, by adding section 41-1291; providing for the delayed repeal of section 41-1291, Arizona Revised Statutes, as added by this act; relating to the joint legislative committee on relations between this state and the Indian nations and tribes.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 41, chapter 7, article 12, Arizona Revised Statutes, is amended by adding section 41-1291, to read:

START_STATUTE41-1291.  Joint legislative committee on relations between this state and the Indian nations and tribes; membership; duties; report

A.  The joint legislative committee on relations between this state and the Indian nations and tribes is established consisting of the following members:

1.  Four members of the house of Representatives who are appointed by the speaker of the house of representatives, not more than two of whom are members of the same political party.  The speaker of the house of Representatives shall appoint one of these members to serve as cochairperson of the committee.

2.  Four members of the senate who are appointed by the president of the senate, not more than two of whom are members of the same political party.  The president of the senate shall appoint one of these members to serve as cochairperson of the committee.

3.  Two members who represent Indian tribes and who are appointed by the speaker of the house of representatives.

4.  Two members who represent Indian tribes and who are appointed by the president of the senate.

5.  One member of the Arizona commission of Indian affairs who is appointed by the governor.

B.  The terms of the nonlegislative members who are appointed pursuant to subsection A are two years beginning on January 1.

C.  Committee members are not eligible to receive compensation, but are eligible for reimbursement of expenses pursuant to title 38, chapter 4, article 2.

D.  Arizona commission of Indian affairs and legislative staff shall provide services and resources as needed to support the work of the committee.

E.  The committee shall:

1.  In coordination with the Indian nations and tribes and the Arizona commission of Indian affairs, develop a model for a formal relationship between this state and the Indian nations and tribes of this state.

2.  Make recommendations on the following:

(a)  Statutory and administrative procedure changes to improve coordination between state, county and tribal governments in providing services to reservation residents.

(b)  Methods to increase partnership efforts between this state, counties and Indian nations and tribes.

(c)  Other methods to improve relationships between state, county and tribal governments.

F.  On or before December 31 of each year, the committee shall submit a written report of its findings and recommendations to the speaker of the house of representatives, the president of the senate and the governor.  The committee shall provide a copy of the report to the secretary of state. Sec. 2.  Repeal

Section 41-1291, Arizona Revised Statutes, as added by this act, is repealed from and after December 31, 2021.

Sec. 3.  Initial members terms; expiration

Notwithstanding section 41-1291, Arizona Revised Statutes, as added by this act, the terms of the initial nonlegislative members of the joint legislative committee on relations between this state and the Indian nations and tribes expire from and after December 31, 2012.
