AN ACT
Establishing a long‑term care facility task force.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Long-term care facility task force; membership; duties; reports; delayed repeal
A. The long‑term care facility task force is established to study and recommend policy and budget options for addressing the department of health services' timely investigation and processing of long‑term care facility complaints and self‑reports to ensure resident health and safety. The task force consists of the following members:
1. The chairpersons of the health and human services committees in the senate and the house of representatives.
2. The ranking minority members of the health and human services committees in the senate and the house of representatives.
3. The director of the department of health services or the director's designee.
4. The director of the department of economic security or the director's designee.
5. The director of the department of economic security's division of aging and adult services – adult protective services or the director's designee.
6. The state long-term care ombudsman or the ombudsman's designee.
7. One representative of a national organization that advocates for persons who are fifty years of age or older who is appointed by the president of the senate.
8. One representative of an area agency on aging in this state who is appointed by the speaker of the house of representatives.
9. Two owners of long‑term care facilities in this state, one of whom is appointed by the president of the senate and one of whom is appointed by the speaker of the house of representatives.
10. Two long‑term care facility administrators, one of whom is appointed by the president of the senate and one of whom is appointed by the speaker of the house of representatives.
11. Two persons who are patient advocates, one of whom is appointed by the president of the senate and one of whom is appointed by the speaker of the house of representatives.
B. The four legislative members of the task force shall elect two cochairpersons, one from each political party, from among the legislative members of the task force.
C. The task force shall:
1. Conduct a comprehensive review of federal and state laws, policies and procedures that impact the department of health services' investigation and processing of long‑term care facility complaints and self‑reports.
2. Examine the department of health services' current and historical budget and staffing levels for investigating and processing long‑term care facility complaints and self‑reports, including funding sources.
3. Identify barriers that impact the department of health services' ability to timely investigate and process long‑term care facility complaints and self‑reports.
D. The task force shall meet at least two times before the interim report is due and an additional two times before the final report is due pursuant to subsection E of this section.
E. On or before January 31, 2021, the task force shall submit to the governor, the president of the senate and the speaker of the house of representatives an interim report on the task force's progress. On or before August 31, 2021, the task force shall submit to the governor, the president of the senate and the speaker of the house of representatives a final report detailing the task force's findings and recommendations for ensuring the department of health services' timely investigation and processing of long‑term care facility complaints and self‑reports, including department of health services' administrative actions, legislative actions, budget needs and funding options. The task force shall provide a copy of the report to the secretary of state.
F. This section is repealed from and after June 30, 2022.
