AN ACT

 

amending Title 15, chapter 14, Arizona Revised Statutes, by adding article 14; relating to postsecondary educational institutions.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 15, chapter 14, Arizona Revised Statutes, is amended by adding article 14, to read:

ARTICLE 14.  NONLETHAL WEAPONS

START_STATUTE15-1899.  Nonlethal weapons; possession on campus; definition

A.  A community college under the jurisdiction of a community college district governing board and a university under the jurisdiction of the Arizona board of regents may not prohibit the possession of a nonlethal weapon by any person who is present on the campus of the community college or university.

B.  For the purposes of this section, "nonlethal weapon" means a weapon that is DESIGNED, MANUFACTUREd AND MARKETED FOR PERSONAL PROTECTION CONSUMER USE, IS NON-EXPLOSIVE, AND IS explicitly designed and developed to incapacitate or repel a person with a low probability of fatality or permanent injury or to disable equipment with minimal undesired damage or impact on the environment.

C.  a university or community college may adopt rules and disciplinary standards if any nonlethal weapon is used or displayed in a non-emergency manner. END_STATUTE
