SENATE Concurrent RESOLUTION 28

Requesting that the Joint Committee on Government and Finance study whether legislation is needed to address privacy in the social care and health-related social needs space.

Whereas, There is a growing need to address the social determinants of health as a strategy for improving overall wellbeing of our citizens; and

Whereas, Social care networks, which are groups of publicly and privately funded organizations that provide social services and share data and provide care across the range of social needs using a closed loop referral system, have become an important part of delivering the services that address these barriers; and

Whereas, There is a growing concern about the sale and misuse of personal information relating to individual’s social care needs that are not protected by the Health Insurance Portability and Accountability Act of 1996 (HIPAA); therefore, be it

Resolved by the Legislature:

That the Joint Committee on Government and Finance commission study to assess how legislation may appropriately address privacy in the social care and closed loop referral system space; and, be it

Further Resolved, That the Joint Committee on Government and Finance report to the regular session of the Legislature, 2024, on its findings, conclusions, and recommendations, together with drafts of any legislation necessary to effectuate its recommendations; and, be it

Further Resolved, That the expenses necessary to conduct this study, to prepare a report, and to draft necessary legislation to be paid from legislative appropriation to the Joint Committee on Government and Finance.
