A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §5-5-2a; to amend
said code by adding thereto a new section, designated §5-10-
22k; to amend said code by adding thereto a new section,
designated §18-7A-26v; and to amend said code by adding
thereto two new sections, designated §18A-4-2c and §18A-4-8j,
all relating to granting all public employees, all teachers,
all service employees, all public employee retirees, all
teacher retirees and all service employee retirees a $1,000
per year permanent pay increase.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §5-5-2a; to amend said
code by adding thereto a new section, designated §5-10-22k; to
amend said code by adding thereto a new section, designated §18-7A-
26v; and to amend said code by adding thereto two new sections,
designated §18A-4-2c and §18A-4-8j, all to read as follows:
CHAPTER 5. GENERAL POWERS AND AUTHORITY OF THE GOVERNOR,
SECRETARY OF STATE AND ATTORNEY GENERAL; BOARD
OF PUBLIC WORKS; MISCELLANEOUS AGENCIES, COMMISSIONS,
OFFICES, PROGRAMS, ETC.
ARTICLE 5. SALARY INCREASE FOR STATE EMPLOYEES.
§5-5-2a. Granting $1,000 annual salary increase effective July 1,
2011.
(a) Every employee on July 1, 2011 shall receive an annual
salary increase of $1,000 per year. This increase shall be
permanent.
(b) This increase is in addition to any across-the-board,
cost-of-living or percentage salary increases which may be granted
in any fiscal year by the Legislature.
(c) This section shall not be construed to prohibit other pay
increases based on merit, seniority, promotion or other reason, if
funds are available for the other pay increases: Provided, That
the executive head of each spending unit shall first grant the
mandated increase in compensation in this section to all eligible
employees prior to the consideration of any increases based on
merit, seniority, promotion or other reason.
ARTICLE 10. WEST VIRGINIA PUBLIC EMPLOYEES RETIREMENT ACT.
§5-10-22k. Granting $1,000 supplemental increase for annuitants
effective July 1, 2011.
(a) Every annuitant, and beneficiaries of deceased members,
on July 1, 2011 shall receive an annual retirement increase of
$1,000 per year. This increase shall be permanent.
(b) The supplement provided by this section is subject to any
applicable limitations thereon under Section 415 of the Internal Revenue Code of 1986, as amended.
CHAPTER 18. EDUCATION.
ARTICLE 7A. STATE TEACHERS RETIREMENT SYSTEM.
§18-7A-26v. Granting $1,000 supplemental increase annuitants
effective July 1, 2011.
(a) Every annuitant, and beneficiaries of deceased members, on
July 1, 2011 shall receive an annual retirement increase of $1,000
per year. This increase shall be permanent.
(b) The supplement provided by this section is subject to any
applicable limitations thereon under Section 415 of the Internal
Revenue Code of 1986, as amended.
CHAPTER 18A. SCHOOL PERSONNEL.
ARTICLE 4. SALARIES, WAGES AND OTHER BENEFITS.
§18A-4-2c. Granting $1,000 annual salary increase effective
July 1, 2011.
(a) Every teacher on July 1, 2011 shall receive an annual
salary increase of $1,000 per year. This increase shall be
permanent.
(b) This increase is in addition to any across-the-board,
cost-of-living or percentage salary increases which may be granted
in any fiscal year by the Legislature.
(c) This section shall not be construed to prohibit other pay
increases based on merit, seniority, promotion or other reason, if
funds are available for the other pay increases: Provided, That

§18A-4-8j. Granting $1,000 annual salary increase effective
July 1, 2011.
(a) All school personnel, other than teachers, on July 1, 2011
shall receive an annual salary increase of $1,000 per year. This
increase shall be permanent.
(b) This increase is in addition to any across-the-board,
cost-of-living or percentage salary increases which may be granted
in any fiscal year by the Legislature.
(c) This section shall not be construed to prohibit other pay
increases based on merit, seniority, promotion or other reason, if
funds are available for the other pay increases: Provided, That
the executive head of each spending unit shall first grant the
mandated increase in compensation in this section to all eligible
employees prior to the consideration of any increases based on
merit, seniority, promotion or other reason.
NOTE: The purpose of this bill is to grant all public
employees, all teachers, all service employees, all public employee
retirees, all teacher retirees and all service employee retirees a
$1,000 per year permanent pay increase.
These sections are new; therefore, they have been completely
underscored.
