A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §47-6-12, relating to prohibiting the use of “script” as change to a consumer unless the consumer gives consent.

Be it enacted by the Legislature of West Virginia:

Article 6. money and interest.


§47-6-12. Prohibiting the use of script as change without customer consent.

Change may not be given in the form of “script” without the consent of a customer at a business or governmental entity. “Script” is hereby defined as tokens, credit cards, company award points, “dope checks,” coupons, and similar devices that are not legal tender issued by the Federal Reserve, US Mint, or state of West Virginia. The full difference between the amount charged by the business and the amount that is tendered by the consumer must be given to the consumer if it is requested by the consumer at the time of the sale.

NOTE: The purpose of this bill is to prohibit the use of “script” as change without the consent of a customer.
