Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 28.2-1309.1 as follows:

§28.2-1309.1. Oyster leaseholders; response to permit applications.

If any oyster leaseholder is requested to respond to a wetlands board or the Commission regarding an application, failure to respond within 30 days following receipt of such request shall be deemed consent to the application.
