A BILL to amend the Code of Virginia by adding in Article 1 of Chapter 10 of Title 32.1 a section numbered 32.1-331.04, relating to in-home consumer-directed services; electronic visit verification; exception.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Article 1 of Chapter 10 of Title 32.1 a section numbered 32.1-331.04 as follows:

§ 32.1-331.04. Electronic visit verification; exception.

A. The Department shall implement an electronic visit verification system to confirm delivery of in-home services by providers of consumer-directed personal care, respite care, or companion services through the Commonwealth Coordinated Care Plus waiver program, Developmental Disability waiver program, or the Early and Periodic Screening Diagnosis and Treatment program and shall require providers of such consumer-directed services to verify the site at which such services are delivered using such electronic visit verification system. The Department may enter into a contract with a vendor to provide access to such electronic visit verification system for use by providers of consumer-directed personal care, respite care, and companion services.

B. The provisions of subsection A requiring verification of the site of service delivery via an electronic visit verification system shall not apply to providers of consumer-directed services described in subsection A who reside in the home of the person receiving services.
