SENATE BILL NO. 1723
AMENDMENT IN THE NATURE OF A SUBSTITUTE
(Proposed by the Senate Committee on Transportation
on January 30, 2019)

A BILL to require the Department of State Police to evaluate cost of inspection of window tint and noise levels of exhaust as part of motor vehicle safety inspections.

Be it enacted by the General Assembly of Virginia:

1. §1. That the Department of State Police shall evaluate the feasibility of including in a motor vehicle safety inspection the inspection of (i) window tint to ensure that tinting is within the legal range established pursuant to §46.2-1052 of the Code of Virginia and (ii) noise levels of exhaust systems to ensure that such noise levels are in compliance with §46.2-1049 of the Code of Virginia. Such evaluation shall include the estimated cost of a motor vehicle safety inspection that includes the inspection of window tint and noise levels of exhaust systems and the amount by which the charges set by §46.2-1167 of the Code of Virginia would increase. The Department of State Police shall complete its evaluation by November 30, 2019, and submit to the General Assembly an executive summary and a report of its findings and recommendations for publication as a House or Senate document. The executive summary and report shall be submitted as provided in the procedures of the Division of Legislative Automated Systems for the processing of legislative documents and reports no later than December 1, 2019, and shall be posted on the General Assembly's website.
