A BILL to amend the Code of Virginia by adding a section
numbered 55-509.1:2, relating to the Virginia Property Owners' Association Act;
lot owner representation on association board.

Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 55-509.1:2 as follows:
§55-509.1:2. Lot owner representation on association board until transfer of control by declarant.
Unless the declaration expressly provides otherwise, until transfer of the common area to the association by the declarant, if there is a lot owner other than the declarant, then membership of the board of directors of the association shall include such lot owners.
