Be it enacted by the General Assembly of Virginia:
1. That §2.2-435.12 of the Code of Virginia is amended and reenacted as follows:
§2.2-435.12. Director of Diversity, Equity, and Inclusion; duties; report.
A. The position of Director of Diversity, Equity, and Inclusion (the Director) is created. The Director shall be appointed by the Governor. The Director shall (i) develop a sustainable framework to promote inclusive practices across state government; (ii) implement a measurable, strategic plan to address systemic inequities in state government practices; and (iii) facilitate methods to turn feedback and suggestions from state employees, external stakeholders, and community leaders into concrete equity policy.
B. The Director shall, when sending any memorandum to a public institution of higher education recommending or mandating diversity of any description, submit copies of such memorandum to the Chairmen of the House Committee on Education and the Senate Committee on Education and Health.
C. By January 1 of each year, the Director shall provide to the Chairmen of the House Committee on Appropriations and the Senate Committee on Finance and Appropriations an itemized list of expenditures made by the office of the Director.
