Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 62.1-44.15:24.1 as follows:
§62.1-44.15:24.1. Applicability of requirements outside Chesapeake Bay watershed.
The Board and the Department, in carrying out the provisions of this article in any locality, no part of which is located within the Chesapeake Bay watershed, shall apply the regulations that were in effect prior to July 1, 2014, and were adopted pursuant to this article to establish minimum design criteria for measures to control (i) nonpoint source pollution and (ii) localized flooding and stream channel erosion.
The provisions of this section shall not affect either the applicability of any law, regulation, or requirement to any land located within the Chesapeake Bay watershed or the permitting authority delegated to the Department by the United States Environmental Protection Agency.
