A BILL to amend the Code of Virginia by adding in Article 3 of Chapter 12 of Title 18.2 a section numbered 18.2-511.2, relating to smoking on public playgrounds; penalty.

Be it enacted by the General Assembly of Virginia:

1.  That the Code of Virginia is amended by adding in Article 3 of Chapter 12 of Title 18.2 a section numbered 18.2-511.2 as follows:

§ 18.2-511.2. Smoking on public playgrounds; penalty.

A. Smoking shall be prohibited on any public playground. As used in this section, "public playground" means any real property owned or operated by the state or a locality or otherwise open to the general public.

B. Any person who continues to smoke on a public playground after having been asked to refrain from smoking shall be subject to a civil penalty of not more than $25.

C. Any law-enforcement officer may issue a summons regarding a violation of this section.

D. Any civil penalties assessed under this section shall be paid into the treasury of the locality where the offense occurred and shall be expended solely for public health purposes.
