HOUSE BILL NO. 1884
AMENDMENT IN THE NATURE OF A SUBSTITUTE
(Proposed by the House Committee on Militia, Police and Public Safety
on January 25, 2019)

A BILL to require the Director of the Department of Corrections to review and revise the Department's visitation policies concerning visitors at state correctional facilities; wearing of tampons or menstrual cups.

Be it enacted by the General Assembly of Virginia:

1. §1. The Department of Corrections shall adopt a policy regarding visitors who may be menstruating at the time of their visit to state correctional facilities. The policy shall include (i) a process to notify such a visitor of the Department's policy in advance of the visit; (ii) an option for the visitor to remove any tampon or menstrual cup and replace it with a state-issued product in order to complete a contact visit; and (iii) an option for a visitor who refuses to remove any tampon or menstrual cup to complete a non-contact visit. The Department shall make the policy available to the public as soon as practicable and shall provide a copy to the Chairmen of the House Committee on Militia, Police and Public Safety and the Senate Committee on Rehabilitation and Social Services by November 1, 2019.
