A BILL to amend the Code of Virginia by adding a section numbered 32.1-325.02:1, relating to medical assistance; determination of income; personal needs allowance.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 32.1-325.02:1 as follows:

§32.1-325.02:1. Determination of income; personal needs allowance.

A. When determining the income of a recipient of medical assistance services who is receiving long-term care in a medical institution or intermediate care facility for the purpose of determining the amount to be used to reduce the Department of Medical Assistance Services' payment to the medical institution or intermediate care facility, the Department of Medical Assistance Services shall disregard a personal needs allowance in an amount that is at least $150.

B. The amount of the personal needs allowance to be disregarded in determining a recipient's income described in subsection A shall be adjusted annually to reflect changes in the Consumer Price Index for all items, all urban consumers (CPI-U), as published by the U.S. Bureau of Labor Statistics.
