HOUSE BILL NO. 1334
AMENDMENT IN THE NATURE OF A SUBSTITUTE
(Proposed by the House Committee on General Laws
on February 9, 2010)

A BILL to amend the Code of Virginia by adding a section numbered 33.1-346.2, relating to disposal on highway etc.; cigarettes; penalty.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 33.1-346.2 as follows:

§33.1-346.2. Disposal of cigarettes on highway, etc.; penalty.

It shall be unlawful for any person to dump or otherwise dispose of a cigarette or part thereof on public property, including a public highway, right-of-way, property adjacent to such highway or right-of-way, or on private property without the consent of the owner thereof or his agent. Any person who violates this section shall be subject to a civil penalty of $75 to be paid into the state treasury and credited to the Literary Fund.

2. That the Supreme Court of Virginia shall add violations of this act to the Non-Traffic Prepayable Offenses and Uniform Fine Schedule.
