Be it enacted by the General Assembly of Virginia:

1. §1. In furtherance of both the need to maintain a reliable and adequate supply of electricity and to address the environmental hazards of abandoned coal mines, the removal of waste coal from previously mined sites in the coalfield region of the Commonwealth for the purpose of using such waste coal as fuel for the generation of electricity is in the public interest and a Phase I or Phase II Utility, as those terms are defined in subdivision A 1 of §56-585.1 of the Code of Virginia, may at any time petition the State Corporation Commission for approval of a rate adjustment clause for recovery on a timely and current basis from customers of the costs of the removal of waste coal from previously mined sites in the coalfield region of the Commonwealth. For the purposes of this act, "waste coal" means usable material that is a byproduct of previous coal processing operations.
