| proposing a constitutional amendment authorizing an appropriation | ||

| BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 49-g, Article III, Texas Constitution, | ||
| is amended by adding Subsection (p) to read as follows: | ||
| (p) Notwithstanding any other provision of this section, | ||
| the legislature may, by a majority vote of the members present in | ||
| each house, appropriate from the economic stabilization fund not | ||
| more than $2,000,000,000 to the Texas Education Agency for the | ||
| Foundation School Program under Chapter 42, Education Code, for the | ||
| state fiscal year beginning September 1, 2012. An appropriation | ||
| made by the 82nd Legislature in anticipation of this subsection | ||
| becoming law is not void due to the appropriation's anticipatory | ||
| character. This subsection expires September 1, 2013. | ||
| SECTION 2. This proposed constitutional amendment shall be | ||
| submitted to the voters at an election to be held November 8, 2011. | ||
| The ballot shall be printed to permit voting for or against the | ||
| proposition: "The constitutional amendment authorizing an | ||
| appropriation from the economic stabilization fund for the | ||
| Foundation School Program." | ||
