A BILL TO BE ENTITLED
 
AN ACT
  relating to requiring the disclosure of public school curricula and
  teaching materials.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Chapter 26, Education Code, is amended by adding
  Section 26.0061 to read as follows:
         Sec. 26.0061.  REQUIRED DISCLOSURE REGARDING CURRICULA AND
  TEACHING MATERIALS. (a) In this section, "teaching material"
  includes:
               (1)  instructional material, as that term is defined by
  Section 31.002;
               (2)  supplemental material;
               (3)  teaching aids; and
               (4)  any other material a student is given the option to
  select for the student's instruction.
         (b)  Subject to Subsection (d), not later than the seventh
  day before the date curricula or teaching materials will be
  implemented, assigned, distributed, or otherwise presented to
  students, each school district and open-enrollment charter school
  shall make those items available to the public on the district's or
  school's Internet website, disaggregated by subject area and grade
  level.
         (c)  Information posted to a school district's or
  open-enrollment charter school's Internet website under Subsection
  (b) must be maintained on the website for not less than 10 years.
         (d)  A school district or open-enrollment charter school
  must make curricula and teaching materials described by Subsection
  (b) available in a manner that complies with copyright law and
  otherwise prevents the items from being copied. Items that cannot
  be made available on the district's or school's Internet website
  must be made available for review by parents in accordance with
  Section 26.006.
         SECTION 2.  This Act applies beginning with the 2024-2025
  school year.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution. If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2023.
