A BILL TO BE ENTITLED
 
AN ACT
  relating to individual graduation committee qualification
  requirements for certain students.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 28.0258, Education Code, is amended by
  amending Subsection (a) and adding Subsection (a-1) and (h-1) to
  read as follows:
         (a)  This section applies only to an 11th or 12th grade
  student who has failed to comply with the end-of-course assessment
  instrument performance requirements under Section 39.025 for not
  more than two courses.
         (a-1)  This section applies to all 12th grade students for
  the 2020-2021, 2021-2022, and 2022-2023 school years without the
  performance requirements under Subsection (a). This subsection
  expires September 1, 2023.
         (h-1)  For the 2020-2021, 2021-2022, and 2022-2023 school
  years, an individual graduation committee may determine that a
  student is qualified to graduate without considering performance on
  any end-of-course assessment instruments administered under
  Section 39.023, Education Code. This subsection expires September
  1, 2023.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution. If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2021.
