| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter E, Chapter 222, Transportation Code, | ||
| is amended by adding Section 222.112 to read as follows: | ||
| Sec. 222.112. CONSIDERATION OF FINANCIALLY INDEPENDENT | ||
| PROJECT REQUIRED. The commission by rule shall adopt procedures to | ||
| require that, for each state highway system project proposed to be a | ||
| toll project, including a managed lane project, the department | ||
| consider financing and operating the project as financially | ||
| independent and not part of a system. | ||
| SECTION 2. This Act takes effect September 1, 2017. | ||
