A BILL TO BE ENTITLED

|
AN ACT
|
|
|
relating to the maximum size of a municipality's extraterritorial |
|
|
jurisdiction. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

|
SECTION 1. Section 42.021, Local Government Code, is |
|
|
amended by adding Subsection (e) to read as follows: |
|
|
(e) Regardless of Subsection (a), the total gross acreage of |
|
|
the extraterritorial jurisdiction of a municipality may not exceed |
|
|
50 percent of the gross acreage of the municipality. A municipality |
|
|
shall release extraterritorial jurisdiction as necessary to comply |
|
|
with this subsection. |

|
SECTION 2. This Act takes effect September 1, 2023. |
