A BILL TO BE ENTITLED
 
AN ACT
  relating to the protection of trade secrets.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 2251.107, Insurance Code, is amended to
  read as follows:
         Sec. 2251.107.  PUBLIC INSPECTION OF INFORMATION.  Each filing
  made, and any supporting information filed, under this chapter is:
               (1)  public information; and
               (2) subject to the provisions of Chapter 552,
  Government Code [open to public inspection as of the date of the
  filing].
         SECTION 2.  Subdivision (8), Section 2251.002, Insurance
  Code, is amended to read as follows:
               (8)  "Supporting information" means:
                     (A)  the experience and judgment of the filer and
  the experience or information of other insurers or advisory
  organizations on which the filer relied;
                     (B)  the interpretation of any other information
  on which the filer relied;
                     (C)  a description of the methods used in making a
  rate; and
                     (D)  any other information the department
  requires to be filed under Section 38.001.
         SECTION 3.  This Act takes effect September 1, 2011.
