A BILL TO BE ENTITLED

|
AN ACT
|
|
|
relating to export fees charged by the Middle Pecos Groundwater |
|
|
Conservation District; changing a fee. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 8851.104(b), Special District Local Laws |
|
|
Code, is amended to read as follows: |
|
|
(b) In addition to other fees assessed by the district, the |
|
|
district may assess a fee on groundwater transferred out of the |
|
|
district in accordance with Section 36.122(e)(1) or (2), Water |
|
|
Code, in an amount not to exceed 10 percent of the amount of the fee |
|
|
assessed for the production of water for use in the district if a |
|
|
production fee is assessed. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2017. |
