A BILL TO BE ENTITLED
 
AN ACT
  relating to the issuance of a certificate of convenience and
  necessity for providing electric service in the extraterritorial
  jurisdiction of a municipality.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 37.056, Utilities Code, is amended by
  adding Subsection (g-1) to read as follows:
         (g-1)  In an application proceeding for a municipally owned
  utility seeking a certificate for a new transmission line or
  facility in the extraterritorial jurisdiction of the municipality,
  an electric utility may file a motion requesting that the
  commission consider granting the certificate to the electric
  utility. Subsections (e) and (f) do not apply to the new
  transmission facility or line if a motion is filed under this
  subsection. 
         SECTION 2.  This Act takes effect September 1, 2021.
