| necessity for providing electric service in the extraterritorial | ||
| jurisdiction of a municipality. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 37.056, Utilities Code, is amended by | ||
| adding Subsection (g-1) to read as follows: | ||
| (g-1) In an application proceeding for a municipally owned | ||
| utility seeking a certificate for a new transmission line or | ||
| facility in the extraterritorial jurisdiction of the municipality, | ||
| an electric utility may file a motion requesting that the | ||
| commission consider granting the certificate to the electric | ||
| utility. Subsections (e) and (f) do not apply to the new | ||
| transmission facility or line if a motion is filed under this | ||
| subsection. | ||
| SECTION 2. This Act takes effect September 1, 2021. | ||
