relating to the issuance of a certificate of convenience and | ||
necessity for providing electric service in the extraterritorial | ||
jurisdiction of a municipality. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 37.056, Utilities Code, is amended by | ||
adding Subsection (g-1) to read as follows: | ||
(g-1) In an application proceeding for a municipally owned | ||
utility seeking a certificate for a new transmission line or | ||
facility in the extraterritorial jurisdiction of the municipality, | ||
an electric utility may file a motion requesting that the | ||
commission consider granting the certificate to the electric | ||
utility. Subsections (e) and (f) do not apply to the new | ||
transmission facility or line if a motion is filed under this | ||
subsection. | ||
SECTION 2. This Act takes effect September 1, 2021. |
