AN ACT
|
|
relating to an exemption for school districts from security for |
|
court costs and appeal bond. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Chapter 6, Civil Practice and Remedies Code, is |
|
amended by adding Section 6.004 to read as follows: |
|
Sec. 6.004. SCHOOL DISTRICTS EXEMPT FROM SECURITY FOR COURT |
|
COSTS AND APPEAL BOND. A school district may institute and |
|
prosecute suits without giving security for cost and may appeal |
|
from judgment without giving supersedeas or cost bond. |
|
SECTION 2. Section 6.004, Civil Practice and Remedies Code, |
|
as added by this Act, applies only to a suit or appeal filed on or |
|
after the effective date of this Act. A suit or appeal filed before |
|
the effective date of this Act is governed by the law as it existed |
|
immediately before the effective date of this Act, and that law is |
|
continued in effect for that purpose. |
|
SECTION 3. This Act takes effect September 1, 2011. |
