A BILL TO BE ENTITLED

AN ACT
|
|
|
relating to the statute of limitations for a suit on performance |
|
|
bonds. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Sec. 2253.078(a), Government Code, is amended to |
|
|
read as follows: |
|
|
(a) A suit on a performance bond may not be brought after the |
|
|
first anniversary of the earlier of: (1) the date of final |
|
|
completion, (2) the date of abandonment, or (3) the date of |
|
|
termination of the public work contract. |
|
|
SECTION 2. This act takes effect September 1, 2023. |
