A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to certain restrictions on package store permit holders. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 22.06(a), Alcoholic Beverage Code, is |
|
amended to read as follows: |
|
(a) Except as otherwise provided in Section 102.05, no |
|
person who holds a package store permit or owns an interest in a |
|
package store may have a direct or indirect interest in any of the |
|
following: |
|
(1) a brewer's [, retail dealer's on-premise,] or |
|
general or branch distributor's license; |
|
(2) a [wine and malt beverage retailer's, wine and malt |
|
beverage retailer's off-premise, or] mixed beverage permit; or |
|
(3) the business of any of the permits or licenses |
|
listed in Subdivisions (1) and (2) of this subsection. |
|
SECTION 2. Section 22.14(d), Alcoholic Beverage Code, is |
|
amended to read as follows: |
|
(d) Subsections (a), (b), and (c) shall not apply to a |
|
package store that: |
|
(1) qualifies for exemption under Section 11.50; |
|
(2) is adjacent [or] to the premises of a business |
|
covered by a wine only package store permit, wine and malt beverage |
|
retailer's permit, or wine and malt beverage retailer's off-premise |
|
permit operated by the package store permit holder; or |
|
(3) is located in a hotel that qualifies for exemption |
|
under Section 102.05. |
|
SECTION 3. Section 22.16, Alcoholic Beverage Code, is |
|
repealed. |
|
SECTION 4. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2023. |
