A BILL TO BE ENTITLED
 
AN ACT
  relating to constitutional allocations of money for emergency
  medical services and trauma care systems.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  The heading to Section 316.093, Government Code,
  is amended to read as follows:
         Sec. 316.093.  ADJUSTMENT OF CONSTITUTIONAL ALLOCATIONS [TO
  FUND AND STATE HIGHWAY FUND].
         SECTION 2.  Sections 316.093(b) and (c), Government Code,
  are amended to read as follows:
         (b)  If the sum described by Subsection (a) is less than the
  sufficient balance adopted under Section 316.092, the comptroller
  shall reduce the allocations [allocation] to the state highway fund
  and to the account in the general revenue fund for emergency medical
  services and trauma care systems provided by Section 49-g(c),
  Article III, Texas Constitution, and increase the allocation to the
  economic stabilization fund, in an equal total amount, until the
  sufficient balance adopted under Section 316.092 is achieved.
         (c)  If under Section 316.092 a sufficient balance has not
  been adopted for the comptroller to consider under this section,
  the comptroller shall adjust the allocation of amounts to be
  transferred to the fund, [and to] the state highway fund, and to the
  account in the general revenue fund for emergency medical services
  and trauma care systems provided by Section 49-g(c), Article III,
  Texas Constitution, so that the total of those amounts is
  transferred to the economic stabilization fund, except that the
  comptroller shall reduce a transfer made under this subsection as
  necessary to prevent the amount in the fund from exceeding the limit
  in effect for that biennium under Section 49-g(g) of that article.
         SECTION 3.  Section 771.072(f), Health and Safety Code, is
  amended to read as follows:
         (f)  The comptroller shall deposit the surcharges and any
  prior balances in accounts in the general revenue fund in the state
  treasury until they are allocated to regional planning commissions,
  other 9-1-1 jurisdictions, and regional poison control centers in
  accordance with this section. From those accounts, the amount
  necessary for the commission to fund approved plans of regional
  planning commissions and regional poison control centers and to
  carry out its duties under this chapter shall be appropriated to the
  commission.  The account is composed of money deposited to the
  account under this subsection and one-half of the money allocated
  to an account in the general revenue fund for emergency medical
  services and trauma care systems under Section 49-g, Article III,
  Texas Constitution.  Section 403.095, Government Code, does not
  apply to an account established by this subsection.
         SECTION 4.  Section 773.006(b), Health and Safety Code, is
  amended to read as follows:
         (b)  The account is composed of money deposited to the
  account under Article 102.0185, Code of Criminal Procedure, and
  one-half of the money allocated to an account in the general revenue
  fund for emergency medical services and trauma care systems under
  Section 49-g, Article III, Texas Constitution.
         SECTION 5.  This Act takes effect on the date on which the
  constitutional amendment proposed by the 85th Legislature, Regular
  Session, 2017, providing for the use and dedication of certain
  money transferred to the general revenue fund account for emergency
  medical services and trauma care systems is approved by the voters.  
  If that amendment is not approved by the voters, this Act has no
  effect.
