A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the authority of a county to regulate lot frontages on |
|
certain roads. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 232.103, Local Government Code, is |
|
amended to read as follows: |
|
Sec. 232.103. LOT FRONTAGES. (a) By an order adopted and |
|
entered in the minutes of the commissioners court and after a notice |
|
is published in a newspaper of general circulation in the county, |
|
the commissioners court may adopt reasonable standards for minimum |
|
lot frontages on existing county roads and establish reasonable |
|
standards for the lot frontages in relation to curves in the road. |
|
(b) A commissioners court may adopt reasonable standards |
|
for minimum lot frontages on all proposed and existing roads in the |
|
unincorporated area of the county if authorized to do so by the |
|
qualified voters of the county at an election held for that purpose. |
|
The commissioners court shall order an election under this |
|
subsection on receipt of a petition signed by a number of registered |
|
voters equal to at least 20 percent of the number of qualified |
|
voters who voted in the most recent county election. The |
|
commissioners court may not call the election on its own motion. |
|
(1) Subsection (b) only applies to a county that: |
|
(a) has a population between 30,000 and 40,000 |
|
(b) borders a county with a population of 1.7 |
|
million |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2021. |
