relating to the authority of a county to regulate lot frontages on | ||
certain roads. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 232.103, Local Government Code, is | ||
amended to read as follows: | ||
Sec. 232.103. LOT FRONTAGES. (a) By an order adopted and | ||
entered in the minutes of the commissioners court and after a notice | ||
is published in a newspaper of general circulation in the county, | ||
the commissioners court may adopt reasonable standards for minimum | ||
lot frontages on existing county roads and establish reasonable | ||
standards for the lot frontages in relation to curves in the road. | ||
(b) A commissioners court may adopt reasonable standards | ||
for minimum lot frontages on all proposed and existing roads in the | ||
unincorporated area of the county if authorized to do so by the | ||
qualified voters of the county at an election held for that purpose. | ||
The commissioners court shall order an election under this | ||
subsection on receipt of a petition signed by a number of registered | ||
voters equal to at least 20 percent of the number of qualified | ||
voters who voted in the most recent county election. The | ||
commissioners court may not call the election on its own motion. | ||
(1) Subsection (b) only applies to a county that: | ||
(a) has a population between 30,000 and 40,000 | ||
(b) borders a county with a population of 1.7 | ||
million | ||
SECTION 2. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2021. |
