| relating to the creation of an advisory committee by the Railroad | ||
| Commission of Texas to facilitate the movement of natural gas to | ||
| high priority customers during periods of emergency. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Amend Subchapter C, Natural Resources Code by | ||
| adding a new Section 82.01 to read as follows: | ||
| Sec 81.073 CREATION OF ADVISORY COMMITTEE TO FACILITATE THE | ||
| MOVEMENT OF NATURAL GAS TO HUMAN NEEDS CUSTOMERS DURING AN | ||
| EMERGENCY. (a) The Railroad Commission will establish an advisory | ||
| committee to be known as the Texas Energy Reliability Council | ||
| (TERC) to coordinate and facilitate natural gas supplies to human | ||
| needs and other high priority needs during emergencies when the | ||
| supply of natural gas may not be sufficient to meet the demand for | ||
| natural gas. It may establish the TERC by either adopting a rule or | ||
| by entering an order | ||
| (b) The Railroad Commission will appoint the members of the | ||
| TERC to include at least the following: | ||
| (1) representatives of state agencies or other | ||
| governmental entities that the Railroad Commission determines will | ||
| be necessary or useful in accomplishing the goals of the TERC; | ||
| (2) entities which operate facilities essential or | ||
| useful to the natural gas supply chain; | ||
| (3) entities which operate facilities essential or | ||
| useful to the provision of electric power to human needs customer; | ||
| (4) organizations or individuals with useful | ||
| knowledge of the natural has supply chain or the provision of | ||
| electric power to the public. | ||
| (c) The Railroad Commission is authorized to convene the | ||
| TERC at such time and places and in such manner as it deems | ||
| necessary or useful in accomplishing the goals of TERC. | ||
| (d) The Railroad Commission will appoint a Chairman from | ||
| among the members it appoints | ||
| (e) Chapter 2110 Government Code does not apply to the | ||
| Commission or the TERC with regard to the creation or operation of | ||
| TERC. | ||
| (f) The TERC is not a governmental entity subject to | ||
| Chapters 551 or 552 of the Government Code. | ||
| (g) The Railroad Commission shall adopt such rules as it | ||
| deems necessary or useful with regard to the organization and | ||
| operation of the TERC. | ||
| SECTION 3. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article II, Texas Constitution. If this Act | ||
| does not receive the vote necessary for immediate effect, this Act | ||
| takes effect September 1, 2021. | ||
