relating to the creation of an advisory committee by the Railroad | ||
Commission of Texas to facilitate the movement of natural gas to | ||
high priority customers during periods of emergency. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Amend Subchapter C, Natural Resources Code by | ||
adding a new Section 82.01 to read as follows: | ||
Sec 81.073 CREATION OF ADVISORY COMMITTEE TO FACILITATE THE | ||
MOVEMENT OF NATURAL GAS TO HUMAN NEEDS CUSTOMERS DURING AN | ||
EMERGENCY. (a) The Railroad Commission will establish an advisory | ||
committee to be known as the Texas Energy Reliability Council | ||
(TERC) to coordinate and facilitate natural gas supplies to human | ||
needs and other high priority needs during emergencies when the | ||
supply of natural gas may not be sufficient to meet the demand for | ||
natural gas. It may establish the TERC by either adopting a rule or | ||
by entering an order | ||
(b) The Railroad Commission will appoint the members of the | ||
TERC to include at least the following: | ||
(1) representatives of state agencies or other | ||
governmental entities that the Railroad Commission determines will | ||
be necessary or useful in accomplishing the goals of the TERC; | ||
(2) entities which operate facilities essential or | ||
useful to the natural gas supply chain; | ||
(3) entities which operate facilities essential or | ||
useful to the provision of electric power to human needs customer; | ||
(4) organizations or individuals with useful | ||
knowledge of the natural has supply chain or the provision of | ||
electric power to the public. | ||
(c) The Railroad Commission is authorized to convene the | ||
TERC at such time and places and in such manner as it deems | ||
necessary or useful in accomplishing the goals of TERC. | ||
(d) The Railroad Commission will appoint a Chairman from | ||
among the members it appoints | ||
(e) Chapter 2110 Government Code does not apply to the | ||
Commission or the TERC with regard to the creation or operation of | ||
TERC. | ||
(f) The TERC is not a governmental entity subject to | ||
Chapters 551 or 552 of the Government Code. | ||
(g) The Railroad Commission shall adopt such rules as it | ||
deems necessary or useful with regard to the organization and | ||
operation of the TERC. | ||
SECTION 3. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article II, Texas Constitution. If this Act | ||
does not receive the vote necessary for immediate effect, this Act | ||
takes effect September 1, 2021. |
