A BILL TO BE ENTITLED
 
AN ACT
  relating to the creation of an advisory committee by the Railroad
  Commission of Texas to facilitate the movement of natural gas to
  high priority customers during periods of emergency.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Amend Subchapter C, Natural Resources Code by
  adding a new Section 82.01 to read as follows:
         Sec 81.073  CREATION OF ADVISORY COMMITTEE TO FACILITATE THE
  MOVEMENT OF NATURAL GAS TO HUMAN NEEDS CUSTOMERS DURING AN
  EMERGENCY. (a) The Railroad Commission will establish an advisory
  committee to be known as the Texas Energy Reliability Council
  (TERC) to coordinate and facilitate natural gas supplies to human
  needs and other high priority needs during emergencies when the
  supply of natural gas may not be sufficient to meet the demand for
  natural gas. It may establish the TERC by either adopting a rule or
  by entering an order
         (b)  The Railroad Commission will appoint the members of the
  TERC to include at least the following:
               (1)  representatives of state agencies or other
  governmental entities that the Railroad Commission determines will
  be necessary or useful in accomplishing the goals of the TERC;
               (2)  entities which operate facilities essential or
  useful to the natural gas supply chain;
               (3)  entities which operate facilities essential or
  useful to the provision of electric power to human needs customer;
               (4)  organizations or individuals with useful
  knowledge of the natural has supply chain or the provision of
  electric power to the public.
         (c)  The Railroad Commission is authorized to convene the
  TERC at such time and places and in such manner as it deems
  necessary or useful in accomplishing the goals of TERC.
         (d)  The Railroad Commission will appoint a Chairman from
  among the members it appoints
         (e)  Chapter 2110 Government Code does not apply to the
  Commission or the TERC with regard to the creation or operation of
  TERC.
         (f)  The TERC is not a governmental entity subject to
  Chapters 551 or 552 of the Government Code.
         (g)  The Railroad Commission shall adopt such rules as it
  deems necessary or useful with regard to the organization and
  operation of the TERC.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article II, Texas Constitution. If this Act
  does not receive the vote necessary for immediate effect, this Act
  takes effect September 1, 2021.
