A BILL TO BE ENTITLED
 
AN ACT
  relating to certain groundwater withdrawals allowed by the Edwards
  Aquifer Authority.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Chapter 626, Acts of the 73rd Legislature,
  Regular Session, 1993, is amended by adding Section 1.21 to read as
  follows:
         Sec. 1.21.  CERTAIN INCREASED WITHDRAWALS ALLOWED. (a)
  This section applies only to a municipally owned water utility in a
  municipality with a population greater than one million located
  inside the authority's boundaries.
         (b)  Notwithstanding a provision of this article or of a
  permit issued under this article that is inconsistent or in
  conflict with this section, the authority shall allow a municipally
  owned water utility to withdraw an amount of groundwater to provide
  a military installation with potable water or water for
  infrastructure maintenance or operations of the military
  installation if the military installation agrees to reduce its
  groundwater withdrawals from the same aquifer by that amount under
  a contract with the utility that authorizes the utility to supply
  the installation with that amount of groundwater for those
  purposes.
         SECTION 2.  Section 1.21, Chapter 626, Acts of the 73rd
  Legislature, Regular Session, 1993, as added by this Act, applies
  to a contract entered into before, on, or after the effective date
  of this Act.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2013.
