relating to the release of student directory information by a | ||
public institution of higher education. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter Z, Chapter 51, Education Code, is | ||
amended by adding Section 51.9716 to read as follows: | ||
Sec. 51.9716. CONFIDENTIALITY OF STUDENT DIRECTORY | ||
INFORMATION. (a) In this section, "institution of higher | ||
education" has the meaning assigned by Section 61.003. | ||
(b) Except as provided by Subsection (c) and to provide | ||
privacy protections in addition to those provided under the Family | ||
Educational Rights and Privacy Act of 1974 (20 U.S.C. Section | ||
1232g), an institution of higher education may not sell or release | ||
information the institution designates as directory information | ||
about a student under that federal law, including the student's | ||
name, e-mail address, physical address, and telephone number, | ||
unless the student or the student's parent, if applicable, provides | ||
the institution written consent. | ||
(c) An institution of higher education is not prohibited | ||
from releasing designated directory information if the institution | ||
releases the information under an exception provided under the | ||
Family Educational Rights and Privacy Act of 1974 (20 U.S.C. | ||
Section 1232g(b)) for the release of education records without the | ||
written consent of a student or a student's parent, if applicable. | ||
SECTION 2. This Act takes effect September 1, 2021. |
