A BILL TO BE ENTITLED
 
AN ACT
  relating to electric reliability standards adopted by the Public
  Utility Commission of Texas.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 38.005, Utilities Code, is amended by
  adding Subsections (g) and (h) to read as follows:
         (g)  The independent organization described by Section
  39.151 shall determine the amount of reserve capacity necessary to
  maintain a 1 in 10 reliability standard in the ERCOT power region.
         (h)  By January 1, 2014, the PUC shall determine whether the
  reliability standards adopted under Subsection (a) do ensure that
  the ERCOT power region's electrical network maintains the amount of
  reserve capacity determined to be necessary under Subsection (g).  
  The PUC shall report its findings under this subsection to the
  Legislature.
 
         SECTION 2.  This Act takes immediate effect if it receives a
  vote of two-thirds of all members elected to each house, as proved
  by Section 39, Article III, Texas Constitution.  If this Act does
  not receive the vote necessary for immediate effect, this Act takes
  effect September 1, 2013.
