A BILL TO BE ENTITLED
 
AN ACT
  relating to the obstruction from public view of flaring at a natural
  gas liquefaction facility and liquefied natural gas export
  terminal.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 382.051961, Health and Safety Code, is
  amended by adding Subsection (d) to read as follows:
         (d)  A permit by rule or a standard permit relating to a
  natural gas liquefaction facility and liquefied natural gas export
  terminal must require any elevated flare stack or ground flare
  located at the facility to be constructed in a manner that obscures
  from public view any flaring occurring at the facility.
         SECTION 2.  Section 382.051961(d), Health and Safety Code,
  as added by this Act, applies only to a permit the application for
  which is filed with the Texas Commission on Environmental Quality
  on or after the effective date of this Act. A permit the
  application for which is filed before the effective date of this Act
  is governed by the law in effect on the date of filing, and that law
  is continued in effect for that purpose.
         SECTION 3.  This Act takes effect September 1, 2021.
