relating to the obstruction from public view of flaring at a natural | ||
gas liquefaction facility and liquefied natural gas export | ||
terminal. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 382.051961, Health and Safety Code, is | ||
amended by adding Subsection (d) to read as follows: | ||
(d) A permit by rule or a standard permit relating to a | ||
natural gas liquefaction facility and liquefied natural gas export | ||
terminal must require any elevated flare stack or ground flare | ||
located at the facility to be constructed in a manner that obscures | ||
from public view any flaring occurring at the facility. | ||
SECTION 2. Section 382.051961(d), Health and Safety Code, | ||
as added by this Act, applies only to a permit the application for | ||
which is filed with the Texas Commission on Environmental Quality | ||
on or after the effective date of this Act. A permit the | ||
application for which is filed before the effective date of this Act | ||
is governed by the law in effect on the date of filing, and that law | ||
is continued in effect for that purpose. | ||
SECTION 3. This Act takes effect September 1, 2021. |
