relating to vehicle modification services provided under the | ||
vocational rehabilitation program. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter C, Chapter 352, Labor Code, is | ||
amended by adding Section 352.109 to read as follows: | ||
Sec. 352.109. APPORTIONED VEHICLE MODIFICATION SERVICES. | ||
(a) If, after a vehicle modification review is conducted, it is | ||
determined that a portion of an applicant's requested vehicle | ||
modifications is not safe, the commission shall: | ||
(1) inform the applicant about the unsafe | ||
modification; and | ||
(2) on the applicant's request, make a determination | ||
regarding whether the unsafe modification violates state or federal | ||
law or regulations and, if the commission determines that the | ||
unsafe modification does not violate applicable state or federal | ||
law or regulations: | ||
(A) provide those modifications that were | ||
determined safe; and | ||
(B) allow the applicant to pay out-of-pocket for | ||
those modifications that were determined unsafe. | ||
(b) The commission shall adopt rules necessary to implement | ||
this section. | ||
SECTION 2. This Act takes effect September 1, 2021. |
