A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to a memorandum of understanding between public schools |
|
authorizing a school marshal of one school to act as a school |
|
marshal at the other school during an event at which both schools |
|
participate. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 37.0811, Education Code, is amended by |
|
adding Subsection (i) to read as follows: |
|
(i) A school district or open-enrollment charter school may |
|
enter into a memorandum of understanding with another school |
|
district or open-enrollment charter school under which a school |
|
marshal appointed to a campus of the district or school may |
|
temporarily act as a school marshal at a campus of the other |
|
district or school for the duration of an event occurring at the |
|
campus of the other district or school at which both districts or |
|
schools are participating. The memorandum of understanding must |
|
comply with the requirements for written regulations under this |
|
section and may be used to satisfy the requirement for written |
|
regulations or written authorization under Section 46.03(a)(1), |
|
Penal Code, to allow that school marshal to carry a firearm on the |
|
premises of the district or school at which the event occurs. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2023. |
