| relating to the number of persons authorized to reside in certain | ||
| homes and facilities for persons with disabilities. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 123.006, Human Resources Code, is | ||
| amended by adding Subsection (c) to read as follows: | ||
| (c) The limitation on the number of persons who may reside | ||
| in a community home at the same time imposed by this section does | ||
| not apply to an assisted living facility licensed under Chapter | ||
| 247, Health and Safety Code, unless the assisted living facility | ||
| qualifies as a community home in accordance with Section 123.004. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2019. | ||
