A BILL TO BE ENTITLED
 
AN ACT
  relating to the composition of the structural pest control advisory
  committee.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 1951.101(a), Occupations Code, is
  amended to read as follows:
         (a)  The committee consists of nine members appointed by the
  commissioner as follows:
               (1)  [two members who are experts in structural pest
  control application;
               [(2)]  three members who represent the public;
               (2)  three members [(3)     one member from an institution
  of higher education who is knowledgeable in the science of pests and
  pest control;
               [(4) one member] who represent [represents] the
  interests of structural pest control operators and who are [is]
  appointed based on recommendations provided by a trade association
  of operators; and
               (3)  three members [(5)  one member] who represent
  [represents] the interests of structural pest control operators and
  who are experienced in the area of integrated pest management
  programs in schools [consumers; and
               [(6)     the commissioner of state health services or the
  commissioner's designee].
         SECTION 2.  Section 1951.103(b), Occupations Code, is
  amended to read as follows:
         (b)  A person may not be a member of the committee if:
               (1)  the person is an officer, employee, or paid
  consultant of a Texas trade association in the field of pest control
  except as provided by Section 1951.101(a)(2) [1951.101(a)(4)]; or
               (2)  the person's spouse is an officer, manager, or paid
  consultant of a Texas trade association in the field of pest
  control.
         SECTION 3.  Section 1951.101(c), Occupations Code, is
  repealed.
         SECTION 4.  The changes in law made by this Act in the
  qualifications of members of the structural pest control advisory
  committee do not affect the entitlement of a member serving on the
  committee immediately before the effective date of this Act to
  continue to serve for the remainder of the member's term.  As the
  terms of committee members expire, the commissioner of agriculture
  shall appoint or reappoint a member who has the qualifications
  required for a member under Section 1951.101(a), Occupations Code,
  as amended by this Act.
         SECTION 5.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2013.
